In June, the DOL issued a notice of proposed rulemaking regarding the FMLA’s definition of the term “spouse.” See, e.g., DOL, Wage & Hour Div., Fact Sheet: Proposed Rulemaking to Amend the Definition of Spouse in the Family and Medical Leave Act Regulations, available here. The Family and Medical Leave Act (FMLA) allows eligible employees of employers with 50 or more employees to take up to 12 workweeks of leave for, among other things, the birth and care of the employee's newborn child and for the employee's own serious health condition. The Department of Labor enforces the FMLA.

FMLA entitles eligible employees to take up to 12 weeks of unpaid, job- protected leave in a 12-month period for specified family and medical reasons. The employer may elect to use the calendar year, a fixed 12-month leave or fiscal year, or a 12-month period prior to or after the commencement of leave as the 12-month period. The DOL has just issued a new fact sheet, Fact Sheet #77B: Protection for Individuals under the FMLA, that addresses the protections afforded to individuals against employer retaliation. This is not new law, but certainly provides an indication of how the DOL views the issue. In 2015, the DOL issued a fact sheet explaining that an employee would be entitled to FMLA leave to care for a child under the same circumstances as a biological or legal parent so long as the employee has assumed parental responsibilities for a child.
